Welcome to Ex Umbra. These Terms of Service (“Terms”) govern your access to and use of our website, products, services, checkout, communications, and any related content we provide (collectively, the “Site” or “Services”).
By visiting our Site or purchasing from us, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.
1. About Ex Umbra
Ex Umbra sells fragrance and related goods, including limited-run perfume products and accessories. Throughout these Terms, “Ex Umbra,” “we,” “us,” and “our” refer to EX UMBRA LLC, doing business as Ex Umbra.

2. Eligibility
By using the Site, you confirm that you are at least the age of majority in your state or country of residence, or that you are using the Site with the consent of a parent or legal guardian.
You agree not to use the Site or our products for any unlawful purpose or in violation of these Terms.
3. Product Information
We do our best to describe and photograph our products accurately. However, product images, packaging, colors, fill levels, and presentation may appear slightly different depending on lighting, screen settings, production batch, or packaging availability.
Because Ex Umbra products may be produced in limited batches, minor variation between batches may occur. These variations are part of the nature of small-batch fragrance production and do not necessarily mean that a product is defective.
4. Fragrance Use and Safety
Our products are intended for external use only unless clearly stated otherwise.
By purchasing or using our products, you agree to use them responsibly and according to any instructions, warnings, or ingredient information provided with the product or on the Site.
Do not ingest our products. Avoid contact with eyes, broken skin, irritated skin, and sensitive areas. Discontinue use immediately if irritation, allergic reaction, or discomfort occurs. Keep products away from children, pets, open flames, and excessive heat.
Fragrance products may contain alcohol, fragrance compounds, essential oils, aroma materials, and other ingredients that can cause sensitivity in some individuals. If you have known allergies, sensitivities, medical conditions, or concerns about ingredients, you should review the product information carefully before purchase and consult a qualified professional if necessary.
We are not responsible for reactions, sensitivities, misuse, or failure to follow product instructions.
5. Orders
When you place an order, you agree that all information you provide is accurate, current, and complete. This includes your name, shipping address, billing information, email address, and any other required checkout details.
We reserve the right to refuse, cancel, limit, or modify any order for any reason, including suspected fraud, incorrect pricing, product unavailability, payment issues, shipping restrictions, or violation of these Terms.
An order confirmation does not guarantee acceptance of your order. Your order is accepted when we process and ship it.
6. Limited-Run Products and Availability
Some Ex Umbra products may be made in limited quantities. Availability is not guaranteed until your order has been accepted and fulfilled.
We may limit quantities, discontinue products, change packaging, update formulations, or modify product offerings at any time without notice.
7. Pricing and Payment
Prices are listed in U.S. dollars unless otherwise stated. Prices may change at any time without notice.
You agree to pay all charges associated with your order, including product price, shipping, taxes, duties, and any other applicable fees.
We use third-party payment processors to process payments. We do not store your full payment card information.
8. Taxes, Duties, and Import Fees
You are responsible for any applicable sales tax, use tax, VAT, customs duties, import charges, brokerage fees, or other government-imposed fees related to your order.
For international orders, the recipient is responsible for compliance with all import rules, customs requirements, and local laws in the destination country. We are not responsible for packages refused, delayed, seized, returned, or destroyed by customs or local authorities.
9. Shipping
We will make reasonable efforts to ship orders within the timeframe stated on the Site or at checkout. If no specific shipping timeframe is provided, we will make reasonable efforts to ship within 30 days of your order.
Shipping estimates are not guarantees. Delivery times may vary depending on carrier delays, weather, customs processing, address issues, product availability, or other circumstances outside our control.
If we are unable to ship within the stated timeframe, we may contact you with an updated estimate and, where required, give you the option to accept the delay or cancel for a refund.
Once a package is transferred to the carrier, risk of loss may pass to the customer to the extent permitted by law. However, if your package is lost, delayed, or damaged in transit, please contact us at [support email] and we will review the issue in good faith.
10. Incorrect Shipping Information
You are responsible for providing a complete and accurate shipping address. We are not responsible for orders shipped to an incorrect or incomplete address provided by the customer.
If an order is returned to us because of an incorrect address, failed delivery, refusal, or failure to pick up the package, we may offer reshipment at the customer’s expense or issue a refund minus shipping and handling costs, where permitted by law.
11. Returns, Refunds, and Cancellations
Because fragrance is a personal-use product, we may not be able to accept returns of opened, used, altered, or damaged products unless required by law.
If your order arrives damaged, incorrect, or defective, contact us at info@exumbra.co within 7 of delivery with your order number and photos of the issue.
Refunds, replacements, or store credits are reviewed on a case-by-case basis. We reserve the right to deny refund or replacement requests where there is evidence of misuse, fraud, abuse, or violation of these Terms.
Orders may be cancelled before they ship, but cancellation is not guaranteed. Once an order has been fulfilled, packed, or shipped, it may no longer be cancellable.
12. Final Sale Items
Certain products may be marked as final sale, including limited releases, samples, discovery items, custom products, promotional items, discounted items, or opened fragrance products. Final sale items are not eligible for return, refund, or exchange unless required by law or unless the product arrives damaged, incorrect, or defective.
13. Promotions, Discounts, and Gift Cards
Promotions, discount codes, credits, and gift cards may be subject to additional terms. Unless stated otherwise, discounts cannot be combined, applied retroactively, exchanged for cash, or used after expiration.
We reserve the right to modify, suspend, or cancel promotions at any time.
14. User Content and Reviews
If you submit reviews, comments, photos, messages, feedback, testimonials, social media posts, or other content related to Ex Umbra, you grant us a non-exclusive, worldwide, royalty-free license to use, repost, display, reproduce, edit, and share that content for marketing, promotional, and business purposes.
You are responsible for any content you submit. You agree not to submit content that is unlawful, false, misleading, defamatory, abusive, obscene, infringing, or otherwise inappropriate.
We may remove, edit, or decline to publish user content at our discretion.
15. Intellectual Property
All content on the Site, including names, logos, trademarks, product names, images, copy, graphics, packaging design, videos, layout, and branding, is owned by or licensed to Ex Umbra and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, sell, exploit, or use our content without our prior written permission.

If you sign up for email or SMS marketing, you consent to receive promotional and transactional messages from Ex Umbra. Message frequency may vary. Standard message and data rates may apply.
You can unsubscribe from marketing emails by using the unsubscribe link in the email. You can opt out of SMS messages by replying STOP, where applicable.
Transactional messages related to orders, shipping, account activity, or customer service may still be sent where permitted by law.

22. Limitation of Liability
